On a review of the video of the July 16, 2001 meeting it is apparent that other councillors at the break were talking with other people in the gallery. It is very apparent from a full review of the proceedings on July 16, 2001 that council was acting in its political role. Council had a resolution before it, there was an amendment to the resolution which would have given effect to the submissions made by the applicant, but this amendment was lost. Council was on July 16, 2001 when it considered this matter, acting in its capacity as a political or legislative body. Therefore, the standard of review as set out in United Enterprises v. Saskatchewan Liquor and Gaming Commission, supra, does not apply in these circumstances.
