The next case is Sandhoff v. Metzer (1906) 4 W.L.R. 18. This was also decided by Wetmore, J. and at p. 19 he says: “There has been great delay * * * and I am of the opinion that it has not been satisfactorily accounted for.” This delay was from the end of October to January of the following year. The excuse was that which is urged in this case, that the defendants did not understand the proceedings, being foreigners. As to this he says, at p. 20: “Reasons of this sort cannot be encouraged. I think that even a foreigner ought to understand that sheriff’s officers do not travel long distances to serve them with papers just for amusement, and the fact of the service of the papers should put them on the alert.”
