The standard of review on pure questions of law is one of correctness. The standard of review for findings of fact requires a palpable and overriding error. A palpable error is one that is obvious or plainly seen: Housen v. Nikolaisen, 2002 SCC 33 at para. 5. An overriding error is an error that affects the outcome of the case.
