The appeal will be allowed and the judgment below set aside. The question of costs has given me some difficulty but I think in all the circumstances I am justified in exercising a discretion as was done in Gaunt v. Jones [1948] 4 DLR 308, affirming [1947] OWN 885. There will be no costs, either on the appeal or in the action below.
