Rajan was followed in Verich v. Canada, [1996] F.C.J. No. 400 (Noël J.) and Weir v. Canada, [1998] F.C.J. No. 494 (McKeown J.). Verich relied upon Rothstein J.'s argument that the application was premature, while Weir referred to prematurity and lack of jurisdiction.
