The standard of review when assessing findings of fact and findings of fact based on inferences is that of palpable and overriding error and its functional equivalents, including “clearly wrong”, “unreasonable” and “not reasonably supported by” the evidence (Housen v. Nikolaisen, 2002 SCC 33, [2002] 2 S.C.R. 235; and H.L. v. Canada (Attorney General), 2005 SCC 25 at para. 110, [2005] 1 S.C.R. 401).
