The Province also relies on the fact the trailers were hooked up upon delivery. However, these actions constitute post-contractual conduct which may only be considered where there is ambiguity in the contract that cannot be resolved through the text and circumstances of formation: Wade v. Duck, 2018 BCCA 176 at para. 28. The judge found no ambiguity and, as a result, could not consider post-contractual conduct.
