However, the offence of conspiracy to commit an illegal act is different from the underlying substantive offence. A conspiracy is made out where the evidence establishes the intention of two or more individuals to enter into an agreement or plan that has as its object the commission of a common illegal act. In the case of the offence of conspiracy to traffic in illegal drugs, the object of the plan includes the possession, obtaining, transporting and delivering of a substantial quantity of illegal drugs, including payment for these services: Sokoloski v. The Queen, 1977 CanLII 17 (SCC), [1977] 2 S.C.R. 523 at 534-535.
