The claim to conspiracy to commit perjury cannot stand because statements of witnesses giving evidence in a judicial or quasi-judicial proceeding are protected by the witness immunity rule. This fundamental rule of law provides absolute privilege for words spoken or written in judicial pleadings: Workum v. Olnick at para. 6. The rule applies to claims that parties and their solicitors conspired to commit perjury: see Mayer v. Mayer at 171.
