It has been long recognized that an unregistered interest in land lies within the policy of the Registry Act and was, in equity, enforceable against a subsequent purchaser, but only where there was actual notice: Peterkin v. McFarlane, [1884] O.J. No. 107, affirmed by [1885] S.C.J. No. 45; 13 S.C.R.
