As stated in Carey v. Laiken, the court’s contempt power is discretionary and it should not be used to obtain compliance with court orders (at para. 36). Further, “a judge may properly exercise his or her discretion to decline to impose a contempt finding where it would work an injustice in the circumstances of the case.” (at para. 37)
