The learned trial judge then referred to the decision Prosofsky v. R. (1975), 29 C.R.N.S. 245, and he went on to state: I conclude that the accused in driving his vehicle for 13 kilometres after dark at a speed in excess of 155 kilometres per hour and in passing not only the traffic he did but the intersection of entrance roads to Midale and Macoun in addition to the intersections with at least ten grid roads failed to drive with the care a prudent driver would drive on a major provincial highway. Therefore I find the accused guilty as charged.
