In Smith v. Co-operative Fire (supra) the background to the insurer's refusal was based on its policy not to insure mobile homes which distinguishes that case from the case at bar. In addition, in that case the trial judge noted that in his view "refusal must be restricted to refusal by a person authorized to accept or reject an application". (P. 123).
