The following excerpt is from Stefan v. Lichter, 2005 SKQB 383 (CanLII):

In the event that the defendants do not make application within the time stated, or do not pursue such application with due diligence, the plaintiff shall be entitled to damages for loss of his bargain. These damages awarded must constitute a true substitute for specific performance and, as such, it is consistent with the rules of common law to assess damages at the date of trial. (Semelhago v. Paramadevan, 1996 CanLII 209 (SCC), [1996] 2 S.C.R. 415).
