From the decision cited by counsel, Lindsay v. Heagle 1935 CanLII 145 (SK CA), [1935] 2 W.W.R. 373, it would appear that the question whether the circumstances warrant an extension of time is largely a matter of discretion to be exercised by the Judge to whom the application is made. In this case the grounds for extending the time appear to me more cogent than the grounds which were held sufficient therefor in the case cited.
