In Canada, the law of restitution has long recognized that while a court may refuse to give effect to a contract, it may still allow a plaintiff to recover on a quantum meruit basis for services rendered or goods supplied in reliance upon the existence, validity, and enforceability of an alleged contract: Deglman v. Guarantee Trust Company and Constantineau 1954 CanLII 2 (SCC), [1954] S.C.R. 725.
