Punitive damages are available in the context of tort or restitutionary claims such as breach of fiduciary duty and more rarely in cases of breach of contract where the conduct is “deserving of punishment because of its harsh, vindictive, reprehensible and malicious nature: Vorvis v. Insurance Corp. of British Columbia 1989 CanLII 93 (SCC), [1989] 1 S.C.R. 1085 at para. 1107 and 1008.
