Is there any case law where a delay in applying for probate has been successful?

British Columbia, Canada

The following excerpt is from Harland v Harland Estate, 2015 BCSC 2666 (CanLII):

In Oates v. Baker, 1993 CanLII 1921 (B.C.S.C.), a delay of three years had passed before probate was applied for. Though the delay does not appear to have been expressly addressed in the reasons, an application to pass over the executor was dismissed.
