In Mukuka v. Fort Optical Ltd. [1994] B.C.J. No. 1445 (S.C.), the plaintiff’s position as manager of an optical store was terminated when the store was closed. She was 45 and had worked for the defendant for about 12 years. She supervised one part time employee, and the court found she was a low level manager. Leaving aside the issue of mitigation, the appropriate notice period was six months.
