Mother’s counsel provided me with a number of authorities, the most recent being Jahn-Cartwright v. Cartwright [2010 ONSC 923.]. In this matter Justice Price had a number of advantages in assessing the claim: the parties had entered into a Separation Agreement which provided specifics as to their post secondary education funding obligations, the adult son’s actual budget was available, and the son’s ability to contribute to his own expenses was in evidence (although it was disputed.). Following on his analysis, Justice Price made a finding for proportionate sharing by the parents after contribution by the son, and payment of one half of the table amount for the entire 12 months of the year to the mother.
