The following excerpt is from T.R. v. D.R., 2014 BCSC 1027 (CanLII):
This case is not unlike the situation in McPhail v. McPhail, 2001 BCCA 250, where the grounds pled were physical and mental cruelty and marriage breakdown. The parties lived separate and apart for a period of one year, with the year expiring after the first week of the trial. In McPhail, Mr. Justice Donald for the court stated:
