The fact is the wife was dependant on the husband throughout the marriage. It was a “traditional” marriage in the sense that the husband worked, and the wife was responsible for the children and household. She did not become a nutritionist, and he became a dentist. Her income earning capacity is very limited. Having regard to the principles underlying spousal support awards, as discussed in Chutter v. Chutter, 2008 BCCA 507, leave to appeal ref’d Chutter v. Chutter, [2009] SCCA No. 41 at paras. 45-61, the wife has a strong entitlement to spousal support on compensatory and needs grounds.
