In Law Society v. O’Neill, [1995] L.S.D.D. No. 125, another lawyer who was suspended indefinitely pending his reconstruction of books and records, demonstrated to the hearing panel that it was impossible to reconstruct his general account due to the records retention policy of his bank. Counsel for the Law Society agreed that the lawyer had done what he could under the circumstances. The panel reinstated him.
