The following excerpt is from People v. Ortiz, G051255, G051376 (Cal. App. 2017):
instruct the jury. We assume the jury acted in accordance with the instructions it was given. (See People v. Hardy (1992) 2 Cal.4th 86, 208 [jury presumed to follow instructions].) There is no indication the jury considered gang evidence for an improper purpose; indeed neither defendant advances such an argument.
The judgments are affirmed.
