As to the necessity for a demand before action I am of opinion that this is necessary, Brown v. Brown [1893] 2 Ch. 300. That it was made is I think shown by the evidence. On June 31, 1916, plaintiff’s solicitors cabled defendant: Assignment you to corporation contained clause extension to purchasers not operate as release to you. Writ instructed.
