Accordingly, the point of the rule in Weldon v. Neal was that an amendment to an action raising a new cause of action after the expiration of the limitation period should not be allowed, except in “very peculiar circumstances”, for the effect would be to deprive the defendant in the action of a limitation defence it would otherwise have in relation to the new cause of action.
