In Young v. McLellan, 2004 BCSC 995, the plaintiffs sued “Her Majesty the Queen in Right of Canada” for breach of fiduciary duty and various torts. Following Dix, Vickers J. found that “Her Majesty” was not “properly named” and ordered that the “Attorney General of Canada” be substituted.
