I am of the view that whether payment of a debt by a third party discharges the debt depends on the circumstances of the case and the intention of the parties. Thus in Wilchynski v. Williams (1955), 1954 CanLII 175 (SK CA), 14 W.W.R.(N.S.) 137, the circumstances and intentions surrounding the payment of a mortgage were examined in full.
