Whether it is in the public interest to accept a late-filed complaint is determined in light of the purposes of the Code in s. 3, and depends on the circumstances of each case: Chartier v. School District No. 62, 2003 BCHRT 39, para. 14. The length of and the reasons for the delay, and the significance of the allegations, are among the factors which may be considered in determining whether it is in the public interest to accept a complaint: Earnshaw v. Lilydale Cooperative and UFCW, Local 1518, 2005 BCHRT 146; Fontaine v. Ainsworth Lumber, 2005 BCHRT 565.
