Numerous decisions in the wake of Hyrniak v. Mauldin, 2014 SCC 7 (CanLII), [2014] 1 S.C.R. 87, have confirmed that the court does not require a cross-motion for summary judgment when it can decide the issue that was the subject matter of another party’s motion for summary judgment.
