What is the test for finding an abuse of discretion in a sexual assault case?

California, United States of America

The following excerpt is from Rucker v. County Of San Bernardino, E050062, Super.Ct.No. MCVMS06315 (Cal. App. 2010):

"'"Broadly speaking, an appellate court reviews any ruling by a trial court as to the admissibility of evidence for abuse of discretion."'" (Poniktera v. Seiler (2010) 181 Cal.App.4th 121, 142.) We find an abuse of discretion only when there is a clear showing that, under all the circumstances, the trial court's ruling exceeded the bounds of reason. (Ibid.)
