The statute of limitation for a fraud claim is three years and is not "deemed to have accrued until the discovery, by the aggrieved party, of the facts constituting the fraud or mistake." Cal. Civ. Proc. Code 338(d). The statute of limitations for negligent misrepresentation is two years. See Ventura County Nat'l Bank v. Macker, 49 Cal. App. 4th 1528, 1529 (1996).
