In People v. Watson, the defendant had a blood alcohol level of .23 percent, drove through a red light, narrowly avoiding a collision, then accelerated to more than 80 miles per hour, and collided with a vehicle in an intersection, killing two people. Moore points out that he was not under the influence of alcohol, and that he did not have a prior warning such as the near-miss provided in Watson.
