With respect to Condition 2 [the requirement that the property must be held or used for university purposes], counsel for the Universities stated that all the properties are held or used for the provision of food services for students, staff, faculty and guests of a university and as such are being held and used for university purposes. This, he submits is true regardless of whether the food services are being provided directly by the university or by a third party for-profit enterprise (see Assessors of Areas #1 and #10 v. University of Victoria, 2010 BCSC 133).
