He adopted the judgment of Lord Selborne in Barnes v. Addy (1874), 9 Ch. App. 244, who held at page 251 that responsibility may be extended to others who are not trustees who are “… actually participating in any fraudulent conduct of the trustee to the injury of the cestui que trust.”
