Low back pain and the loss of ability to do heavy work was the issue in Tobin v. Monkman. The plaintiff was 24 at the time of the motor vehicle accident. He worked for a logging company. He had been an active snowboarder, and after the accident was no longer able to do the more heavy work or his activities such as snowboarding. He suffered a change of mood and disposition. This was a case where it was found not to be a permanent disability, but the trial judge opined that the plaintiff would suffer for many more years.
