In Thomson v. Thomson, the family lived in Scotland. The child was born in Scotland. Legal proceedings were taken in Scotland and a temporary custody and access order was made in Scotland in proceedings in which both parents participated and attorned. After that order was made, and in breach of that order, the mother took the child to Manitoba and brought an application in Manitoba to permit her to stay there with the child.[14] This is a far cry from the situation in the case at bar.
