I do not know what construction was put upon the statute 46 Edw. III. by the Judges, who had to construe it in those days; but I do know that before I could come to a conclusion, that it applied to proceedings against persons charged with treason or felony, I should have to hear the question argued, and at present it appears to me, that it did not apply to such proceedings until, at all events, they became records by the entry of final judgment. This statute was referred to in the case already cited of Groenvelt v. Burrell, and has been insisted upon time and again by persons charged upon indictments of treason and felony, as entitling them to copies of the indictments but always without success.
