The seminal case of Dunsmuir v. New Brunswick 2008 SCC 9, establishes the starting point for any judicial review. There are two possible standards of review of decisions of administrative bodies, that of correctness or reasonableness. Any judicial review must first determine the standard of review applicable to the case at bar. This determination will inform the reviewing court as to the amount of deference which must be paid to the original decision maker.
