Given the highly discretionary and exceptional nature of s. 24 relief, the standard of review is reasonableness with deference accorded to factual findings and the weighing of factors (Farhat, above). Issues of procedural fairness generally and in this case in particular are reviewed on a standard of correctness (Dunsmuir v. New Brunswick, 2008 SCC 9).
