Scale 3 was intended to compensate for "average" or "ordinary" difficulty and as Low J. (as he then was) observed in Gillis v. Kralj (supra), even if a case is " fairly complicated" and involve “substantial preparation”, it may nevertheless be a case of ordinary difficulty.
