Canadian Road Management Company, 2018 ONSC 2186 [MacLeod], Myers J. noted: “The right to a civil jury trial might therefore have to yield in appropriate cases in order to provide the parties with an expeditious, affordable, and proportionate resolution that is fair and, especially, one that is “just” as we currently comprehend that term.” [See para. 32].
