It is true that in Williams v. Allsup (1861) 10 C.B. (N.S.) 417, 30 L.J.C.P. 353, it was held that the right to use carries with it the right to repair for such use, but an examination of that case shows that the right of user was much more general and extensive than that accorded to Johnston in the present case. I do not think, however, that it is necessary to decide the case on this point, since the defendant has raised the plea of acquiescence.
