The respondent referred to Berry v. Cypost, 2003 BCSC 1827, a decision of Mr. Justice Burnyeat. In that case there was an admission that one of the parties lied in his affidavit of employment. The issue is whether or not that evidence should be excluded because it was made at a without prejudice meeting.
