The current law is that both the “reasonableness” and the “fairness” of the contract must be determined by the circumstances existing at the time the contract was entered into. See Ewachnicuk v. Mander, [1991] B.C.J. No.4018 (Q.L.)(S.C.)(Master) and the Legal Profession Act, s.68(5).
