The following excerpt is from Annand v Annand, 2022 NSSC 70 (CanLII):

The question to be asked is “whether equality would be clearly unfair – not whether on a precise balancing of credits and debits of factors largely imponderable some unequal division of assets could be justified:” Thomas v. Harwood, supra, para 7.

Courts are instructed to examine all the circumstances, and not to simply weigh the respective material contributions of the parties, except in unusual circumstances: Young v. Young, supra, paras 15 and 19. My Decision
