The privilege applies to oral or written communications at either the discovery or the trial stage. There may be a distinctions made in specific cases as to whether the protection ought to be afforded, at discovery or left to the trial judge (See: Schetky v. Cochrane et al., [1917] 1 W.W.R. 852 (B.C.C.A.).
