The plaintiff relied on Delgiglio v. Becker, 2012 BCSC 480. This case does not assist me because the facts are completely different. In that case, the plaintiff suffered a permanent re-aggravation of his neck and a lower back injury which had a significant impact on his life. The court in that case found that the symptoms would not be present but for the accident. He had not returned to his pre-accident level of pain and his prognosis was described as “guarded at best” (at para. 60).
