The following excerpt is from Vic Van Isle Construction Ltd. v. Lomenda, 1999 CanLII 3661 (BC SC):

The plaintiff contends that during the period from June 1998 until the present there was significant contact between the parties and that, accordingly, this time ought not to be considered in a measurement of delay. According to Fraser v. Kokan (1993), 24 C.P.C. (3d) 21 (B.C.S.C.), the relevant point from which to measure delay is from the time the cause of action arose, which in the present case is over 7 years ago.
