Further, and more fundamentally, it alleges a claim which is bad in law. The plaintiff relies on Wells v. Newfoundland, 1999 CanLII 657 (SCC), [1999] 3 S.C.R. 199. In that case the plaintiff’s office was terminated by legislation. The terms of his appointment were that he would serve until the age of 70, subject to good behaviour. The plaintiff sued for compensation.
